In pertinent part:
EXCESSIVE FORCE?
Keel has referred two cases to federal prosecutors to determine whether they involved excessive force.
In one case, the trooper involved ÔÇ£didnÔÇÖt do anything wrong,ÔÇØ Keel said, since he was ÔÇ£pursuing a convicted escapee.ÔÇØ
In internal affairs records obtained by The State, trooper Tony Gardner said he was trying to protect the public in a June 5 incident on the U.S. 76 bridge over the Great Pee Dee River on the Florence-Marion county line.
Gardner told State Law Enforcement Division agents he saw a stolen four-wheeler all-terrain vehicle heading toward him on the bridge and thought the suspect, Timothy Cail ÔÇö a prison escapee ÔÇö would get away if he got past him.
Cail, 32, who escaped from the Palmer Pre-Release Center in Florence, was being pursued from the opposite direction by two Dillon County sheriffÔÇÖs deputies, who were trying to box him in with their patrol cars, records show.
A dashboard video from one of the Dillon deputies ÔÇö obtained last week by The State ÔÇö shows GardnerÔÇÖs patrol car colliding with the ATV and Cail being thrown over the guardrail.
ÔÇ£Trooper Gardner was adamant that he did not deliberately try to hit the 4-wheeler and was only trying to block the 4-wheelerÔÇÖs escape,ÔÇØ according to his SLED statement.
Cail, serving a prison term for burglary in Horry County, eventually was caught by a Marion County deputy. He suffered scratches, according to his SLED statement.
Keel quickly put Gardner, 31, who has been with the patrol two years, on suspension and ordered SLED to investigate, records show. SLED turned its report over to 12th Circuit Solicitor Ed Clements, who declined to charge Gardner.
ÔÇ£It appeared he handled an extremely volatile and dangerous situation with a great degree of poise, calm and good judgment,ÔÇØ Clements said in a July 2 letter to SLED. ÔÇ£I strongly believe that trooper Gardner should be commended.ÔÇØ
Keel gave Gardner a Level II reprimand ÔÇö considered one of the lightest punishments ÔÇö contending the trooper violated department policy by not getting approval from a supervisor during the chase to ÔÇ£implement a forcible stop,ÔÇØ which constitutes ÔÇ£deadly forceÔÇØ under the policy.
Keel told The State that based on his review of the incident and ClementsÔÇÖ opinion, Gardner did not deserve a stiffer punishment. Keel allowed the trooper to return to work.
Still, Keel said he referred the case and another to the U.S. AttorneyÔÇÖs Office out of caution.
