The PCM is looking for a minimum threshold to be reached, sometimes there is also a time window involved, and if the engine is slow to come up to temperature, you can sometimes get a code.

my stat isn't cold it is 190. my fan settings are stock and my engine heats up fast. i appreciate the feedback though. i had the code deleted and went into walmart for a short time. when i came out it threw the code again right away and the engine was still warm at that point. that is what is also making me lean to a bad sensor but i could be wrong.
