Default Muffler laws

Anyone here know what the law is regarding a loud car in N. Chas? Is there a certain decibel that makes the car illegal if there is a muffler on it? Does 13-127 apply to this situation of someone calls and complains?

It would have to be stupidly loud and would likely take more than one complaint. Lots of discretion in this area. Here is a link to muni code. 13-127 would be the one.

That is very vague!

I will type out the whole story tomorrow. Lets just say I have dealt with the cops a few times tonight due to some neighbors who treat me like trash and try to make my life a living hell. Looking into some harassment charges for them.

I have several overlapping noise ordinance codes. Some say after 11pm some do not. If you want a report without talking to the police you can call the duty officer and make a report over the phone. 740-2800. Maybe PM the names of who went to your house.

So these horrible neighbors that have been harassing me finally called the law. They were dispatched for my car being parked (by AverageJoe) in the stripes next to a handicap spot which directly across from my town home. People park here daily and it's normally not a problem.

So AverageJoe backs out of the garage, drives around the parking circle and put it on the stripes while I put the jet ski in the garage. About 15 minutes later, as we were unhooking the trailer and setting up the ski, the officers show up. We were actually just about to leave for SSS.

When they arrived they asked me why the car parked where it was, so I told them what we were doing. I also stated that I knew who called, mentioned that they harass me daily, and apologized for the inconvenience. The officer walked over to the car, touched the hood for warmth, and asked me to move it. He said the hood was still warm (it really wasn't) and the story had to be legit.

All is good right? NOPE!

We hopped in the car to join the guys at SSS and as I was driving by I noticed the officers were talking with the people who complained. I look back and see one officer going to his car. Sure enough he pulled me as I made my way from Wescott to Patriot blvd. He told me what all was going on and said he had to cite me. Claimed that he could hear my car from 50yrds away with his windows up and that I had to quiet it down. I made a point to ask what the proper decibel level was and he could not tell me. However, he did mention that the other officer was taking a report at the time due to the nights events.

The other officer finally joins us on the side of Patriot and gives me the case number on the report. He did mention that it was "non-criminal" and that he notated the harassment I have been dealing with since I moved in last Dec.

Don't get me wrong, I am in no way upset with the officers, they were very professional and understanding of the situation! Honestly, I could have been ticketed for not changing my address, no tag light, and a clear cover over the plate. I will be sure to call the station and give these guys a good word to their CO!

However, my concern is with my driving my car. It's no louder than a Harley and I really like to drive it weekly. I don't want to be pulled over or harassed since the car does have a muffler (Bullet and turn down). I did make a p

What is stupid is some cops will mess with you in a car about loud mufflers but over half the Harleys in Charleston are louder. I have had two tickets in Hanahan for loud mufflers in two different cars.....bunch of BS

It's crazy. These guys obviously knew the people were just trying to mess with me. They basically implied that they HAD to do something.

Now I need to figure out what I can do about my POS neighbors who do not allow me to live my life. They harass myself, Lisa, and even our guests! I am about done with it.

We deal with it all the time. Unfortunately, state law says:

Quote:
SECTION 56-5-5020. Mufflers. [SC ST SEC 56-5-5020]

Every motor vehicle shall at all times be equipped with a muffler in good working order and in constant operation to prevent excessive or unusual noise and annoying smoke and no person shall use a muffler cutout, bypass or similar device upon a motor vehicle upon a highway. The engine and power mechanism of every motor vehicle shall be so equipped and adjusted as to prevent the escape of excessive fumes and smoke.

So, all Matt would have to do is prove he has a muffler in good working order and the ticket would be thrown out?

I see your superglued door lock and I raise you one. I would do a 3AM trip under their car with a drain pan and drain their oil. Most non-car oriented people will just ignore the oil pressure idiot light and keep driving until the engine locks up.

I have no patience for asshole neighbors that choose to go out of their way to make someone else's life miserable for no real reason other than being a self-righteous dick.

I would do similar but instead I would try not to drain all the oil and replace the plug with some candle wax. A few miles down the road and the wax should start melting. My method has the same end result that your method has.

I have allways wondered about the noise on harley's too.Dont know much about them but they don't even have a muffler right? Dont they come like that? Seems a group of them would be askin for a noise ticket, but you never see that...Maybe find someone with a boss hoss 502 big block bike with no muffler and have them ride back and forth infront the neighbors house.Hell maybe have a cook out for the hell's angels.....lol

FYI: Matt I own a decibel meter. We could arrange to take a few readings with it on video if needed.
